How Long Is an Eviction Order Valid in Poland: What to Know Before Selling
An eviction order handed down by a Polish court doesn't come with an expiry date of its own: it stays in force until it's carried out or overturned. What actually has a real deadline worth asking about is the claim to enforce it, not the "validity" of the judgment itself. And a court bailiff, it has to be said, rarely moves faster than strictly necessary.
Short version
An eviction judgment doesn't lose its validity with time, not until it's actually carried out. The claim to enforce it becomes time-barred 6 years after the ruling becomes final, counted from the end of that calendar year. If you want to sell a flat with a judgment like this hanging over it instead of waiting on the bailiff and the municipality, we check where the case actually stands and value the property despite the ongoing procedure.
Does an Eviction Order Expire
The judgment itself has no expiry date. What does become time-barred is the claim to enforce it: 6 years from the date it became final, counted from the end of the calendar year in which that happened. Without an enforcement application filed with a bailiff, the case doesn't move on its own, the judgment just sits there waiting.
What Actually Drags the Case Out
- The right to social housing. If the court granted it, the municipality has to provide alternative housing before the eviction can go ahead. This is usually the longest stage of the whole procedure.
- The protection period. Between November 1 and March 31, evictions can't be physically carried out against anyone entitled to social housing.
- An appeal. Enforcement doesn't start until the judgment is final.
The full rules on tenant protection and the protection period are set out in Poland's Tenant Protection Act.
When It's Worth Getting in Touch
A flat with a tenant who's hard to formally remove practically doesn't sell on the regular market. A buyer using a mortgage needs an empty property, banks insist on it. We buy flats carrying this kind of encumbrance and take over the remaining formal steps ourselves. If you have a final eviction judgment and don't want to wait months or years for the bailiff and the municipality to act, this is a good moment to get in touch.
Honest Terms If You Decide to Sell
- The price is 70-90% of market value, reflecting the property's legal situation.
- The valuation is free, ready within 2 days of contact.
- Closing happens from 4 days after you accept the offer.
- We take over the remaining formal steps against the tenant ourselves.
